General Terms and Conditions

1.     Scope of Application

These General Terms and Conditions (“GTC”) apply to all agreements concerning the purchase of admission tickets (hereinafter “Tickets”) for events organised by Verein zur Förderung der Genusskultur am Arlberg, ZVR: 1615163874, Strass 448, 6764 Lech (hereinafter the “Organiser”), in the version valid at the time of ticket purchase. By purchasing a Ticket, the purchaser accepts these GTC.

 

2.     Conclusion of Contract

The presentation of events and Tickets does not constitute a binding offer. The offer to conclude a contract is made by the purchaser when clicking the button “Order with obligation to pay” (or equivalent wording). The contract shall only be concluded upon electronic receipt of the booking confirmation. The Organiser reserves the right to reject orders without stating reasons.

 

3.     Prices and Payment Terms

Unless otherwise stated, all prices are quoted in Euro and include applicable statutory VAT. Payment shall be made using the payment methods offered during the ordering process. The purchaser’s entitlement to the Ticket arises only upon full receipt of payment.

 

4.     Ticket Delivery

Tickets are generally delivered electronically by e-mail as e-tickets. The purchaser is obliged to verify the correctness and completeness of the Ticket(s) immediately upon receipt. The Organiser shall not be liable for the loss or misuse of Tickets following their proper delivery.

 

5.     Returns, Cancellations and Right of Withdrawal

The purchase of a Ticket constitutes a binding booking. Due to the limited number of participants, the exclusive nature of the events and the organisational and logistical effort involved, Tickets are generally excluded from exchange, return and cancellation. Accordingly, refunds of the Ticket price, whether in whole or in part, are excluded, regardless of the reason for the purchaser’s inability to attend. The statutory right of withdrawal for consumers in distance-selling contracts and any right of cancellation by the purchaser shall not apply.

 

6.     Ticket Transfer and Resale

Tickets may be transferred to another person free of charge at any time. Private transfers of Tickets are permitted. The original purchaser is responsible for informing the transferee (or any subsequent holder) of these GTC and their respective rights and obligations. 

Commercial or professional resale of Tickets without the Organiser’s prior express consent is prohibited. In the event of unauthorised commercial resale or resale to a ticket reseller, the Organiser shall be entitled to invalidate the Ticket and refuse admission.

Where a waiting list exists, the Organiser may, at its sole discretion, assist in arranging replacement participants. No entitlement to such assistance, resale or placement exists.

 

7.     Changes, Cancellation or Postponement of Events

The Organiser reserves the right to modify, postpone or cancel events for important reasons. Important reasons include, but are not limited to, force majeure, official orders or restrictions, the unavailability of speakers, winemakers, presenters or other participants, security concerns, and similar circumstances.

In the event of a complete cancellation of an event, the Ticket price already paid shall be refunded. Any further claims, in particular reimbursement of travel expenses, accommodation costs or consequential damages, are excluded to the extent permitted by law. For consumers, claims relating to damages caused intentionally or through gross negligence shall remain unaffected.

Changes to the programme, venue, schedule, participating persons or individual programme elements shall generally not entitle the purchaser to return Tickets or obtain a refund.

A right to return Tickets or receive a refund shall exist only in the event of material changes. Material changes include cancellation of the advertised winemaker or speaker; or a fundamental change to the nature or character of the event.

The Organiser shall endeavour to publish cancellations, programme changes, changes of venue, schedule changes, changes of participants or changes to individual programme items on the website www.weinbergarlberg.at as soon as reasonably possible. In the event of material changes, the Organiser shall also notify purchasers by e-mail using the address provided during the ordering process. It is the purchaser’s responsibility to stay informed about any other changes.

 

8.     Liability

In business-to-business transactions, the Organiser shall only be liable for damages caused intentionally or through gross negligence. To the extent permitted by law, liability for slight negligence is excluded. In relation to consumers, the Organiser shall be liable for damages caused intentionally or through gross negligence as well as for personal injury. In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence towards consumers is excluded to the extent permitted by law, provided no personal injury is involved.

 

9.     Data Protection

10.  Photography and Video Recordings

Photographs and video recordings may be made during events, in particular for documentation and public relations purposes. By attending an event, participants generally consent to the creation and publication of such recordings unless overriding legitimate interests apply in a specific case.

 

11.  House Rules and Right of Admission

The Organiser exercises the right of admission and authority at the event venue. Where events take place on premises operated by third parties, the house rules of the respective operator shall additionally apply. In the event of conflict, the stricter provisions shall prevail.

Participants must comply with all lawful instructions issued by the Organiser, security personnel, event staff and persons authorised by the Organiser.

The Organiser is entitled to verify the validity of Tickets upon admission, to check the identity and age of participants by means of an official photo identification document and, where necessary for security and event-related reasons, to conduct reasonable visual inspections of bags and luggage.

Such inspections shall be carried out solely for the safety of participants and the proper conduct of the event.

The following items are prohibited:

weapons of any kind;
dangerous objects;
narcotic substances;
pyrotechnic items;
outside food and beverages; and
bulky luggage.

Animals are not permitted, except for officially recognised assistance and service dogs.

Photographs, audio recordings and video recordings made by participants are permitted solely for private use.

Any commercial or professional use, as well as publication beyond the private sphere – particularly in print media, online media or social media for commercial purposes – requires the prior written consent of the Organiser and of any persons whose rights may be affected.

Recordings of presentations, tastings and musical performances are only permitted to the extent expressly authorised by the Organiser. Any copyrights, neighbouring rights and other intellectual property rights of performers and contributors remain unaffected.

The Organiser is entitled to refuse admission to or remove from the event any person who:

violates these house rules;
breaches applicable laws;
fails to comply with lawful instructions;
refuses to surrender prohibited items after being requested to do so;
refuses a reasonable security inspection; or
materially disrupts the event.

In such cases, no claim for reimbursement of the Ticket price or any other compensation shall arise.

 

12.  Youth Protection

For events held in Vorarlberg, the provisions of the Vorarlberger Kinder- und Jugendgesetz (KJG), as amended from time to time, shall apply.

For events held outside Vorarlberg, the youth protection legislation of the respective Austrian federal state shall apply. No alcoholic beverages shall be sold or served to persons under the age of 16. Persons aged 16 to under 18 may only be served non-distilled alcoholic beverages, in particular wine, sparkling wine and beer. Distilled spirits and beverages containing distilled alcohol, including spirits, liqueurs, cocktails and mixed drinks containing spirits, shall only be served to persons aged 18 or older. No further alcoholic beverages shall be served to persons who are visibly intoxicated, regardless of age.

The Organiser is entitled to request an official photo identification document prior to serving alcoholic beverages in order to verify age. Where proof of age is refused or the required minimum age cannot be established beyond doubt, service shall be refused. Participants and their legal guardians or supervisors are responsible for complying with curfew regulations and other youth protection requirements under the KJG. In the event of a violation, the Organiser may remove the relevant person from the event. No claim for reimbursement or other compensation shall arise in such cases.

 

13.  Final Provisions

These GTC shall be governed exclusively by Austrian law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

To the extent permitted by law, the court having subject-matter jurisdiction at the Organiser’s registered seat shall have exclusive jurisdiction for all disputes arising out of or in connection with these GTC.

Should any provision of these GTC be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
